About the policy

If you are a resident of the European Union, the European Economic Area, Norway, the United Kingdom and Switzerland ("Europe"), you enter into these Terms of Use with TelefonID Sverige AB, which is registered and operates under Swedish law with company registration number 559482-1224 and has one office at Stora Nygatan 31, 41108 Gothenburg, Sweden. If you are a resident outside Europe, you are not allowed to use TelefonID services. TelefonID Sverige AB ("TelefonID" or "we") offers users ("Users" or "You") telephone-related services that are implemented through various software applications and services (see www.telefonid.se). These Terms of Use and TelefonID's Privacy Policy (collectively, the "Terms") govern your use of TelefonID's communication services, software, websites, tools or other services and features provided by TelefonID from time to time (collectively, the "Services").

By accessing or using any of the Services, you agree to be bound by these Terms. You accept these Terms and Conditions by downloading TelefonID's software, or by accepting the Terms and Conditions in BankID, or by entering a one-time-code received by SMS or the like, or by using the Services. If you do not agree to these Terms, you may not create an account or use the Services, in particular not pursue a phone call to a person who is a TelefonID User. If you are the caller and need more time to be able to read TelefonID's Terms and Conditions, you should not complete the call, approve in BankID or by entering a one-time-code received by SMS, but instead end the call and read through the Terms and Conditions first. These are available in www.telefonid.se (also as a summary version). By using the TelefonID application, you confirm that you are resident, according to the civil registry, of the country in Europe to which the international area code of the telephone number you have registered for access to our services belongs. You also confirm that the phone number you have registered does not belong to any other individual or company. You also confirm that the BankID that you can use to verify yourself when you use our service and that you use to accept the Terms and Conditions is your own personal BankID and that it is used by yourself on a device that you use. You also confirm that the phoneumber that you can use to verify yourself with one-time-code received by SMS when you use our service and that you use to accept the Terms and Conditions is your own (owned or subscribed to) phonenumber and that it is used by yourself on a device that you use.

If other third-party services are made available as part of our Services, the respective terms of use and privacy policy of the third-party shall apply to all such use by you. Certain features of the Services may be subject to additional guidelines, terms or rules, which will be posted on or on the Services in connection with such features. All such additional terms, guidelines and rules are incorporated by reference into these Terms.

Personal Information

We are committed to protecting the personal information of our Users and the Services. TelefonID's privacy policy describes how we collect, use, share and process personal data and you acknowledge and agree that TelefonID may collect, use, share and process personal data in the manner described therein.

Granting of rights

Unless otherwise agreed separately in writing between us and provided that you comply with these Terms at all times, TelefonID grants you a personal, non-exclusive, non-transferable and limited right to use the Services for your own personal, non-commercial use. You may not use TelefonID's services on any device that you do not own or control. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of TelefonID software. You are not granted any right to use TelefonID's name, trademarks or other commercial symbols. Any rights not expressly granted to you under these Terms shall be retained by TelefonID. If You wish to use any part of the Services as part of Your own application or modify any part of the Services, such use is subject to TelefonID's prior written approval and that You enter into a separate license agreement with TelefonID. You may not use or previously use the Services and copy, modify, or create derivative works included in TelefonID patents or patent pending applications.

User's obligations and limitations

You warrant that all information and other content, such as your phone number, that you may share with TelefonID as a User of the Services (collectively, "Content"), to the best of your knowledge, is accurate, does not violate applicable law, is not someone else's phone number, will not corrupt or interfere with the Services, and that you have the right to share the Content with TelefonID in order for TelefonID to provide the Services and share the Content with other users. You warrant that the phone number presented in the recipient's device is a number that you own or have legal rights to use. At the same time, you guarantee that the number presented is not a fake or incorrect number in order to make it appear that the call is from someone other than it actually is. Unless otherwise agreed separately in writing between us, you may not use the Services or Content commercially or otherwise transfer the Services or Content for payment. You agree not to question TelefonID's rights to, or otherwise attempt to assert any rights in, the Services or any Content provided by other Users, except for those rights expressly granted under these Terms. You agree to use the Services and Content only in the manner expressly permitted by these Terms. You agree not to use the Services, Content, or Information to attempt to circumvent the normal operation of the Services, or reduce the fees or compensations that we may derive from the Services in any way, including by creating multiple accounts, redirecting traffic, following other fraudulent or deceptive methods, creating a parallel archive thereof, or attempting to circumvent the Services or compete with us. Scraping information contained in the Services, using automated systems or software to extract data, including Content and third-party information available through the Services, is strictly prohibited. You may not use the Services or Content in any way that is illegal, harmful, or could be perceived as offensive by TelefonID, other users, or third parties. You agree not to exploit the Services or Content in any unauthorized manner, including but not limited to intrusion or strain on network capacity. You further agree not to use our Services or Content in any way to harass, abuse, stalk, threaten, defame or otherwise insult or insult any other person, company or authority, and you acknowledge and agree that TelefonID is not in any way responsible for any such use by you, or for any harassment; threatening, defamatory, offensive, or unlawful messages or transmissions that you may receive as a result of using the Services. You further agree not to use our Services or our Content in any way to mislead any person, carry out or attempt to carry out fraud, attempt to get someone or explicitly say in a call or write in a text message that the person should provide any account information, log in to BankID or similar verification function, provide passwords, alarm codes, personal data such as social security numbers, provide company details, security details or ask someone to log into accounts such as a bank account, or use any other term that may be considered misleading or be for the purpose of obtaining information about someone that could cause harm (e.g. financial) to the person giving it to you. YOU SPECIFICALLY AGREE NOT TO USE OUR SERVICES OR CONTENT TO ATTEMPT TO COMMIT ANY FORM OF FRAUD OR ACT FRAUDULENTLY. YOU ALSO AGREE NOT TO ATTEMPT OR CONDUCT ANY KIND OF SALE OF A GOOD OR SERVICE OR MARKET RESEARCH. THIS APPLIES EVEN IF THE PRODUCT OR SERVICE IS FREE OF CHARGE.

You further agree not to send SMS or messages with links that, if clicked, could lead to fake websites or to malicious apps/programs. You further agree not to call and hang up after only one or a few signals or use voice messages that are read aloud. You further agree not to use any form of autodialer, computerized dialing systems, AI-generated voices, recorded voice messages, robocall systems, or the like. Notwithstanding any other remedies available to TelefonID, You agree that TelefonID may immediately and at any time, for any reason, suspend or terminate Your use of the Services, block Your calls and Your text messages, or pause and suspend any ongoing calls without notice if You use the Services or Content in any prohibited manner, and that such use will be considered a violation of these Terms. It is unilaterally TelefonID that determines whether You are in breach of these Terms and Conditions, and TelefonID has no obligation to You to report the reasons why You have been suspended from the Service or that Your call or SMS has been blocked. You also agree that TelefonID may analyze real-time phone calls and the content of SMS messages for the purpose of evaluating whether you are violating the Terms in any prohibited manner. You can contact TelefonID via support@telefonid.se to report any violations or infringements of your rights.

Ownership

The Services are protected by copyright laws, patents, patent applications and international copyright treaties, as well as other intellectual property laws and treaties. TelefonID and its licensors shall retain ownership in and to the Services and to all related intellectual property rights, including but not limited to copyrights, trademarks, trade names, logos, database rights, patents and other intellectual or industrial rights held and used by TelefonID as well as those presented in the TelefonID application (including titles, graphics, icons, scripts, source codes, etc.). You are granted only a limited right to use the Services in accordance with these Terms and no intellectual property rights are deemed or will be deemed to be transferred or licensed to you except as provided herein.

Content

You are solely responsible for any Content that you post or communicate directly on or on the Services and you agree to only post or communicate Content that: is true and not false or misleading; is not likely to be considered threatening, defamatory, defamatory, pornographic, racially or ethnically offensive, discriminatory, abusive, defamatory, or otherwise unlawful or inappropriate; belonging to You, or which You have the right to disseminate; does not infringe any third party's intellectual property or privacy rights; does not constitute information that you do not have the legal right to distribute (e.g., inside information or confidential information); does not contain any unsolicited or unauthorized advertising, marketing materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; and does not contain software viruses or any other technology that may harm the Services, or the interests or property of our Services or the other users of the Services; is accurate, fair, and not disparaging to us, the Services, or other users. Further, you agree to be fair, accurate, and non-defamatory when reporting figures, making comments, suggestions, feedback, testimonials, and reviews on or about the Services. TelefonID hereby reserves the right to remove user-generated content from the Services at its sole discretion.

Third-Party Content

The Services may contain links to external content provided by third-party websites and services. Such content, websites and services of third parties may be subject to the respective third party terms and conditions and TelefonID will not be held responsible for such content, websites or services of third parties.

Availability of our services

We work hard to keep our services fully functional and to provide you with the best experience. However, the availability of our services may change from time to time. TelefonID is particularly dependent on the interoperability between TelefonID's platform and various third-party operating systems (especially Android and Apple's iOS) and related app store platforms (especially Google Play and App Store). Our Services may be prevented from working effectively due to certain features provided by such operating systems. We may also experience temporary interruptions due to technical issues, maintenance or testing, or updates to the internet, cloud, and various telecommunications service providers, including those required to reflect changes in relevant laws and regulatory requirements. Events beyond our control, such as government actions, may also affect the availability of our services. Any interruptions can occur without You being notified or noticing, which can lead to incoming calls not being blocked, analyzed and the caller not being identified. TelefonID will not be held responsible for any interruptions that the Service does not work.

Limitations of Liability

You agree that TelefonID shall under no circumstances be liable to You or any other person or company, who uses or previously used or has taken part in the Service or the Content, regardless of whether the Service has been terminated or has/had interruptions, and where as a result of current or previous use: a fraud, a fraudulent deception that leads to any kind of damage, an attempted fraud, death, personal injury; direct, indirect, special, incidental, consequential or punitive damages, damages, including but not limited to pecuniary damages, data dispersal, data breach, goodwill, defamation, lost profits, or any other damages.

In particular, and without limitation, TelefonID shall have no responsibility for any information stored or processed within the Services, including the costs of restoring such information. Your sole right or remedy with respect to any problems or dissatisfaction with the Services is to uninstall the TelefonID Applications and cease using the Services.

TelefonID makes no warranties or representations, express or implied, with respect to the Services, their quality, performance, merchantability, fitness for a particular purpose, availability, interruption of the Services, non-infringement, data security, ability to analyze fraudulent behavior in ongoing calls, ability to block calls and SMS, non-infringement of third party rights. TelefonID is not responsible for the validity, reliability, or accuracy of the content and information provided through and in connection with the use of the Services. TelefonID is thus not responsible for the correctness of information conveyed, said or expressed between the caller and receiving person or what is written in text in SMS or other text messages. Any use of content and information obtained through the use of the Services is at your own discretion and risk.

Support

TelefonID strives to provide adequate and efficient technical support, upgrades and updates to the Services. However, TelefonID shall have no obligation to provide support or maintenance for the Services under these Terms and reserves the right to limit or discontinue support, upgrades and updates provided from time to time.

Transfer

TelefonID reserves the right, at its own discretion, to freely assign and assign rights and obligations under these Terms and Conditions to third parties.

Additional Terms and Changes

TelefonID may change the Services at any time, e.g. by adding or removing features or discontinuing the Services altogether. TelefonID also reserves the right to amend these Terms and Conditions at any time by providing revised Terms to the User or by publishing the revised Terms and Conditions in the Services. In the event of significant changes, the User shall always be informed of this and given the opportunity to immediately terminate the Services. The revised Terms and Conditions will be effective upon such publication or notification to the User. You can always find the latest version of these terms and conditions on https://www.telefonid.se. Your continued use of the Services after posting or notice of any changed terms shall constitute your acceptance of the revised terms.

Legal guarantee

European consumer laws provide you with a legal guarantee that covers the digital services we provide to you. Under this warranty, we are responsible for any non-conformity that you discover at any time during the contractual delivery period. Your national legislation may provide an even longer guarantee. If you would like to make a warranty claim, please contact us.

Third-party distribution channels

Our Services may be made available by downloading the App on the Apple App Store, Google Play Store, or other distribution channels ("Distribution Channels"). If you obtain the "TelefonID" application through a distribution channel, you may be subject to additional terms and conditions for the distribution channel. If you have downloaded the "TelefonID" application from the App Store of Apple Inc or if you are using the "TelefonID" application on an iOS device, you acknowledge that you have read, understood, and agree to the Apple License Agreements.

Governing Law and Country

These Terms and Conditions shall be governed by Swedish law and any disputes arising out of or in connection with these Terms and Conditions may be settled in the Swedish courts. Alternatively, you can use the Swedish National Board for Consumer Disputes' alternative dispute resolution process.
